MINUTES OF THE PUBLIC MEETING OF OCTOBER 12TH, 2004

Called to Order:  7:30 PM under the M.G.L. Chapter 131, s.40 and the Hanson By-Law 1-13, s.5.  by Philip R. Lindquist, Chairman, in the Conservation Office on the second floor of Town Hall.

Public Hearings

8:00 PM  Notice of Intent for construction of a single family dwelling with driveway, septic system, utility connections and minor site grading at terminus of Greenbriar Lane, Map 108, Lot 0024A for Arthur Duffy, Bay Farm Development (Local Filing #04-02)

Craig Nicholson read the Public Hearing Notice and the green cards were checked.   Richard Kirby of LEC made the presentation for the proposal of a single family home.   Mr. Duffy was also present.   Ms. Delaney asked why they were filing under the Local By-law.  Mr. Kirby answered that a similar filing to the Commission was made in 2000.  It was denied.   They applied to DEP for approval and obtained a superseding Order of Conditions.  However, they have modified the design to protect the interests of the By-Law.  A portion of the driveway was reduced to a 9’ width, but is located in the 50-foot no disturb zone.  A variance is being requested. Also, a conservation restriction or deed restriction is being proposed to off set a 3,500 square foot wetland alteration.  Ms. Delaney had made a site visit and found the old wetland flags difficult to ascertain.  She suggested a requirement of a consultant review fee for a wetland line confirmation and to look at the possibility of a Vernal Pool observed on the site walk.  Phil Lindquist read the abutters list.  None were present.

8:15 PM  Notice of Intent for repair of an existing septic system within the 100 ‘ buffer zone of a Bordering Vegetated Wetland and the 100’ inner riparian zone to a perennial stream at 2 Arthur Avenue, Assessor's Map 2, Lot 19 for Neil King, 8 Main St., Kingston, MA represented by Outback Engineering, Inc. 164 E. Grove St., Middleboro, MA.  (New Hearing)  (DEP #175-04)

Craig Nicholson read the Public Hearing Notice and the green cards were checked.   Leann Bradley of Outback Engineering made the presentation for the septic upgrade.  Everything is out of the 50-foot no-disturb zone.   Ms. Delaney had made a site visit and suggested approval as it is an improvement, however, the site is a mess and as a condition would like all trash, old dumpsters, etc. removed by hand.   Phil read the abutter list.  None were present.

Craig Nicholson read the Public Hearing Notice and the green cards were checked.  Bob Crowell from Land Planning, Inc. made the presentation.  Norma Derby was also present.  The septic is out of the 50-foot no-disturb zone.  Ms. Delaney suggested approval.  She recommended that a Request for Determination of Applicability would be sufficient for future filings of this nature.  Phil Lindquist read the abutters list.  None were present.

Craig Nicholson read the Public Hearing Notice and the green cards were checked.   Bob Crowell from Land Planning, Inc. made the presentation and presented a revised plan that was date-stamped in.  Ms. Delaney recommended approval of the project.  Phil Lindquist read the abutters list.  None were present.

Craig Nicholson read the Public Hearing Notice and the green cards were checked.   Tyler Nims made the presentation.  Pierre Monfils was also present.  The wetland line was delineated by Marta Nover.  Ms. Delaney commented that she had observed a drainage ditch in the back of the property that was flowing and it was important to keep it on the plan and for it not to be disturbed.  Phil Lindquist read the abutters list.  None were present.

9:15 PM  Continued Notice of Intent for construction of an addition to the existing structure at 1139 Main St., Assessor's Map 43, Lots 36A & 36B for owner Angelo D’Emilia, Demco Enterprises, 31 Perkins St., Bridgewater, MA  02324.  (DEP #175-)  

Mr. D’Emilia presented a letter  requesting approval for this project.  He has been granted approval by Zoning for the structure.  The original septic design for the previous owner was based on a sieve analysis and the Board of Health had advised him that this was not sufficient for the proposed addition.  Mr. D’Emilia had a perc test done and is now awaiting approval from BOH.  Ms. Delaney informed Mr. D’Emilia that a Stormwater Management Form must be provided because the site is within the Riverfront area.  It would be advisable to revise the Notice of Intent and approach the project as a re-development.  It should be demonstrated that existing conditions would be improved.   Also, a new, revised plan is required.  Bob Crowell from Land Planning, Inc. indicated that he would revise the NOI and submit the necessary paperwork.

Appointments

7:45 PM  Appointment with Beth Brazil from the Manomet Center for Conservation Sciences to gather information regarding technical and support services.

Beth Brazil made a slide presentation and gave the Board a hand-out describing the free, outreach services offered to Hanson including training workshops, open space planning and funding.

Joe Walsh presented a restoration plan requested at the meeting of September 14, 2004 for a buffer-zone disturbance caused during installation of haybales.

Two (2) parcels on Main Street  (Chapter 61A) –  Ms. Delaney had not visited the site.  However, she noted that the larger parcel abuts Conservation Land and Town owned land.  The recommendation of the agent at this point is that the Town purchase the land. She will schedule a site-walk at the site with the owners and prepare comments to the Board of Selectman.
